TERMS OF USE AND PUBLIC OFFER AGREEMENT

1. General Provisions
1.1. This Agreement is a standard form contract concluded in accordance with Articles 633, 634, 641, and 642 of the Civil Code of Ukraine and is equivalent to a contract signed by the parties in written form.
1.2. This offer is the official proposal of the GETTSTYLE online store to conclude a distance purchase and sale agreement for goods via the Online Store.
1.3. The moment of full and unconditional acceptance (acceptance) is considered the fact of the Buyer’s payment for the order.
1.4. By placing an order, the Buyer automatically registers in the Seller’s system and confirms their agreement with these Terms, the Privacy Policy, and the terms of personal data processing in accordance with the Law of Ukraine “On Personal Data Protection” and Regulation (EU) 2016/679 (GDPR).
1.5. The Buyer agrees to receive informational and/or transactional electronic messages at the email address provided when placing the order.
2. Terms and Definitions
In this offer, unless the context requires otherwise, the terms are used as follows:
Goods – clothing, accessories, components and accompanying items, wardrobe items (including outerwear, shoes, headwear, underwear, socks), decorative elements, interior items, home textiles, candles, vases, paintings, posters, and other related style products.


Online Store – an online platform for distance purchase of goods.


Seller/Provider – a private entrepreneur (FOP) selling goods via the Website.


Buyer/User – an individual who has entered into an agreement with the Seller.


Order – the selection of goods by the Buyer, placement, and payment.


3. Subject of the Agreement
3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept them.
3.2. The Agreement regulates:
the selection of goods;


order placement and payment;


processing and delivery of goods;


returns of orders.


4. Rights and Obligations of the Parties
The Seller has the right to:
suspend services in case of violation of the Agreement by the Buyer.


The Seller is obliged to:
timely fulfill confirmed orders;


provide accurate information about goods and delivery conditions.


The Buyer has the right to:
place orders in the Online Store;


demand fulfillment of the Agreement terms.


The Buyer is obliged to:
timely pay for and accept the order;


provide accurate information.


5. Liability of the Parties
5.1. Liability for non-performance or improper performance of the Agreement is determined by the current legislation of Ukraine.
5.2. The Seller is not responsible for:
changes in the appearance of goods by the manufacturer;


color reproduction on the monitor;


delays related to third parties;


actions of the Buyer using their account.


5.3. The Buyer is responsible for their actions related to the use of the Online Store.
5.4. In case of force majeure (war, natural disasters, technical failures, service blockages, cyberattacks, etc.), the parties are released from liability.
5.5. Parties resolve disputes through negotiations, and if no agreement is reached – in court according to applicable law.
6. Payment and Payment Procedure for Goods
6.1. The Buyer has the right to place an order for any goods presented on the Online Store website and available in stock.
6.2. Each item can be ordered in any quantity.
6.3. If one or more goods are out of stock, the Company Manager must notify the Buyer via Telegram or email.
If the Buyer responds on Telegram within 24 hours, all details regarding replacement, partial shipment, or cancellation of the order are agreed upon in correspondence.
If no response is received within 24 hours, the Manager sends an informational email.
6.4. In case of full cancellation of the order, funds are automatically refunded to the Buyer.
6.5. In case of partial unavailability, the email will list the unavailable items. The Buyer is refunded only for the unavailable items. Shipment of the remaining order occurs after Buyer confirmation.
6.6. In case of unavailability, the Buyer has the right to:
receive a full refund;


refuse the item;


cancel the order.


6.7. Payment for goods is made by the Buyer via non-cash payment through the Online Store. Payment for delivery services is made according to the carrier's tariffs upon receipt.
6.8. If payment is not received, the Online Store reserves the right to cancel the order.
7. Delivery Terms and Conditions
7.1. Delivery is made to carrier warehouses where orders are issued, or via courier to the address specified by the Buyer, according to the chosen carrier’s conditions and rates.
7.2. Goods of different brands may be stored in different warehouses. In such cases, the order may be split into multiple parcels with corresponding tracking numbers and delivery conditions. Information is displayed in the cart during checkout.
7.3. Documents are provided according to Ukrainian law. Electronic fiscal receipts and/or payment confirmations and order information are sent to the Buyer’s email.
7.4. For delivery, the Online Store shares Buyer personal data (full name, phone number, delivery address or warehouse number) with logistic partners (e.g., Nova Poshta, Mist Express). Data is used solely for order delivery and processed according to data protection law and GDPR.
7.5. Delivery payment is made by the Buyer according to the carrier’s rates upon receipt. For European deliveries via Mist Express, payment is made on the website during checkout.
7.6. Delivery times:
Ukraine (Nova Poshta): as indicated on the product page in "Delivery and Returns"; cost according to carrier rates.
7.7. Cash on Delivery
The Customer may choose the “Cash on Delivery” (COD) payment method when using the Nova Poshta delivery service.
7.8. Prepayment (Deposit)
To confirm the order, the Customer pays 300 UAH for each brand present in the cart.
Payment is made online through the WayForPay payment system.
7.9. Product Value Limit
Cash on Delivery is available only for items where the price per unit does not exceed 15,000 UAH.
7.10. Purpose of the Prepayment
The prepayment serves as a deposit to cover the Seller’s logistics expenses if the Customer fails to collect the parcel and does not fulfill their obligation.
7.11. Prepayment Refund
If all items are in stock, the prepayment is applied toward the final payment for the order.
In the case of partial availability:
the prepayment is refunded only for the brands whose items are unavailable;
for brands with available items, the prepayment is applied toward payment for those items.
If the order is fully canceled or if all items are unavailable, the prepayment is refunded in full.
If the Customer does not collect the parcel:
if the Customer did not pay for delivery and return shipping — the prepayment is non-refundable;
if the Customer paid for delivery and return shipping themselves, the prepayment is refunded after the brand receives the returned item(s) within 1–3 business days.
7.12. Payment of the Remaining Balance
The Customer pays the remaining amount at the Nova Poshta branch at the time of receiving the order.
7.13. Free Delivery
The free delivery offer for orders above 5,000 UAH does not apply to orders placed with Cash on Delivery.
International Deliveries (Europe — Mist Express)
For deliveries to European countries via Mist Express, up to 10 additional business days are added to the domestic delivery timeframe.
The shipping cost is determined according to the carrier’s price list, depending on the parcel dimensions and the destination country.
7.14. Promotional Offers
The online store may provide marketing or promotional delivery offers (e.g., free delivery within Ukraine for orders over 5,000 UAH).
The terms of such promotions are displayed on the website and may be changed without prior notice.
7.15. Selection of Delivery City
When placing an order on the website, the Customer independently selects the delivery city, the preferred delivery method (to a branch or by courier), and the specific branch number or delivery address.
8. Returns of Goods of Proper Quality
8.1. The Buyer may return goods of proper quality within 14 calendar days of receipt, provided the goods are unused, retain their commercial appearance, original packaging, and documents (according to Part 1, Article 9 of the Law of Ukraine “On Consumer Rights Protection”).
Goods of proper quality fully match the seller's description. Non-returnable items include those listed in Resolution No. 172 of 19.03.1994 (underwear, socks, swimsuits, hosiery, gloves, other personal hygiene items).
Only goods purchased from the Seller and unused are returnable. Custom-made or personalized items are non-returnable and non-exchangeable (Part 5, Article 13, Law of Ukraine “On Consumer Rights Protection”).
8.2. Returns are at the Buyer’s expense unless otherwise provided by law or agreement.
8.3. After brand confirmation of return, the Seller refunds the Buyer within 7 business days, excluding delivery costs if not prepaid.
8.4. During returns, the Seller may process personal data (full name, contact info, bank details) solely for fulfilling return and refund obligations, in accordance with the Privacy Policy, Ukrainian Law, and GDPR.
9. Late Order Pickup
9.1. If the order arrives at the carrier warehouse (e.g., Nova Poshta), the Buyer must pick up the goods within the storage period.
9.2. If the free storage period ends, the Online Store sends a notification (e.g., via Telegram). The Buyer must confirm receipt or refusal.
9.3. If the Buyer does not pick up the goods or confirm receipt, the Online Store may initiate return.
9.4. According to Nova Poshta rules, free storage lasts 7 calendar days; afterwards, storage fees may apply.
9.5. After return, funds are refunded minus delivery and return costs according to carrier rates.
9.6. If delivery and return costs exceed the order amount, the Buyer must cover the difference.
9.7. If delivery was not prepaid and the Buyer does not pick up the parcel, the Online Store may charge actual logistics costs, including return. Failure to pay may restrict future orders or lead to debt collection.
10. Other Terms
10.1. The Seller may unilaterally change the Agreement by posting a new version on the website. Changes take effect upon posting. Continued use constitutes acceptance.
10.2. The Online Store functions as a distance goods purchase platform.
10.3. The Buyer consents to personal data processing for execution of this Agreement (identification, communication, order processing, delivery, accounting, and tax requirements) in accordance with Ukrainian Law and GDPR.
10.4. Payment confirms full agreement with the Agreement.
10.5. The electronic agreement is concluded at the moment of acceptance.
10.6. Product review and order placement are free.
10.7. Buyer personal data is used solely to fulfill this Agreement; the Seller implements organizational and technical measures to protect data.
10.8. Buyer rights include:
access, correction, restriction, or deletion of personal data;


objection to processing;


data portability;


withdrawal of consent at any time without affecting prior lawful processing;


filing complaints with the supervisory authority (Ukrainian Human Rights Commissioner or EU authority).

11. Intellectual Property
11.1. All site materials (texts, photos, videos, graphics, logos, design) are owned by the Seller or partners.
11.2. Use without written consent is prohibited.
12. Disclaimer of Warranties
12.1. The Site and its content are provided "as is". No guarantee of uninterrupted operation or absence of technical failures.
13. Jurisdiction
13.1. Legal relations are governed by Ukrainian law.
13.2. Disputes are resolved in court at the Seller’s location.
14. Term of the Agreement
14.1. The electronic agreement is concluded at acceptance per the Law of Ukraine “On Electronic Commerce”.
14.2. Early termination by mutual consent is possible before actual delivery.
14.3. Unilateral termination is possible in case of breach or as provided by law.
14.4. According to Ukrainian law, the official website https://gettstyle.com allows individuals and legal entities to use the platform for selling goods.
